Dear All,
Pursuant to the General Circular No. 13/2013 and General Circular No. 2/2016 dated 29th July, 2013 & 15th January, 2016 respectively issued by the Ministry of Corporate Affairs (MCA), it has been clarified that a HUF or its Karta cannot become the Partner or Designated Partner in the LLP.
In light of the aforesaid facts, you are requested to clarify whether an Individual can become a Designated Partner or a Partner in LLP in its individual capacity when he is a Karta of a HUF??
