Itrv rejected reason filing date has exceeded return date

Hi All

This is my Case

Filed return on 27/07/2011 for AY 2011-12 and sent ITR V within a month. But  i guess due to postal department it never reached.

Got a mail from IT Office that return not filed.

So finally sent the ITR V again and on 25/11/2011 got the status

ITRV rejected  Reason Filing date has exceeded return date.

I have a refund of Rs 10,000 due.

Now what are my options

Do i file a revised return.

Is it too late to file a revised return as i feel you have to file within some 60 days of reply.

I also tried filing a revised return and chose option 12 u/s 139(4) but getting following error while validating

Return type in sheet : Income details must be original when return NOT filed under S139(5)

So when i select 15 under sec 139(5) and validate, sheet is ok, but i am in doubt whether to file under 139(4) or 139(5)

I am not even sure if i need to file a revised return.

139(5) can be done from one year from the end of the relevant assessment year provided the original return was filed within the due date. and 139(4) is when u have not filed the return within due date u can file the return in one year from the end of the relevant assessment year. 

In your case i would urge u to file 139(5) and send the ITR V again. 

But i have never heard that the verification form has been rejected. 

even if it is belated they accept the form.

As per the status in the Website i see that following is the current status

ITRV rejected  Reason Filing date has exceeded return date

When i called CPC cell and put in my acknowledgment  no in the automated system i got a reply that

This has been passed to the Jurisdiction officer.

So maybe you are right in saying that they have accepted the belated return but i will call CPC cell and confirm once.

In case they have accepted the original return even if it reached late, then do i have to file a revised return as you mentioned u/s 139(5)

If yes, do i have to send my original ITR V which was filed within due date on 27, July 2011

In all cases they accept the return. Rarest cases they reject the verification form. and if it has been accepted then dont file the revise return and send it again. u can check whether it has been accepted or not. IN MYACCOUNT CLICK ON EFILING PROCESSING STATUS AND SEE WHETHER IT HAS PROCESSED OR NOT.

This is what it shows online in my account.

When i called CPC cell the automated system said its been sent to jurisdiction officer. I guess they might not have updated the status online. I will call the CPC cell again and talk to someone over there.

What do you suggest

Just call and then do the necessary. I think they would accept the same. The due date for submission of ITR-V is 120 days from the date of upload of e-return. so in ur case it has not exceeded 120  days so u can call and tell them.

I am having the same issue... do let me know did you file the return for previous year again, ...
