ITR tax return related query

If a person having income from salary and also having income from future and Options. Bought nifty option and sale within same day. In statement of capital gain summary, It is written that Profit form Options (Non speculative).

My query is whether income is speculative or non speculative?

Can i show income as Short term capital gain and file ITR 2 OR consider income as speculative income and file ITR 3?

You may file ITR 2 with the trade declaration under 'Other Income'.

Nifty option sale is non speculative business income whether squared off in one day or not .

 

So it should come as non speculative business income and ITR3 should be filed strictly as per law.
