Quick Summary
A senior citizen earning interest, dividends, occasional LTCG and freelance consultancy income seeks guidance on the correct ITR form. The key issue is whether professional consultancy income requires ITR-3 and whether ITR-1 can be used in years without capital gains.

The senior citizen must file ITR-3. Even though their income is below ₹50 Lakhs and they qualify for professional presumptive taxation (Section 44ADA), the presence of Long-Term Capital Gains (LTCG) automatically disqualifies them from using ITR-4, making ITR-3 the correct choice.

Good morning Sharmaji,

if there is no LTCG (it depends on the particular year transaction) then can we file under ITR1?
