Quick Summary
This discussion addresses whether an individual with a GST turnover of Rs. 70 Lacs and well-maintained proper books of accounts can file their Income Tax Return (ITR) using ITR-3, even if they choose not to avail the presumptive income benefit under section 44AD. The consensus is that filing ITR-3 is permissible with proper financial records like a Balance Sheet and Profit & Loss account, and an audit is generally not required unless section 44AD was opted for in previous years and the five-year limit hasn't been met.

Yes, he can file ITR-3 without audit.

However, if he has previously opted for 44AD, then audit will be applicable.
Yes I agreed with Mr CA Rohit Garg,

@ Santhosh,

as per above reply if the person not opt 44ad in previous years then audit is applicable (not complete 5 years).

otherwise no issues for filling ITR 3. Bcoz, ITR 3 is suitable for all the conditions to individual...
Even if you opt for presumptive taxation u/s 44AD you can choose to submit all the financial records and for that you will not required to get books of accounts audited.
