Hi, I'm a software engineer deputed in UK for 130 days in the assesment year 2013-14.I paid the income tax in UK for the income I earned in UK and I have the salary slips and P60 certificate for that. Could you please tell me In my case what will be the value of 'Relevant Article in DTAA' in TR_FA tab found in ITR 2 form since I want to claim relief under the section u/s 90 on my global income? Is it ARTICLE 16?

 Exempt income of more than 5000 needs ITR2. In Schedule FSI, fill the details of income, forming part of total income, accruing or arising outside India. Schedule FA needs to be filled up by a resident assessee. It need not be filled up by a ‘not ordinarily resident’ or a ‘non-resident’
 

 

Hi, Thanks for your response.But could you please let me know the India-Uk DTAA article no to get the relief under section 90.I fall into the ordinary resident category and a salaried emoployee working in a private company.

Hi Ani,

 

1. Tab TR_FA is an auto fill form, which takes data fom tab FSI. So firstly fill data in tab FSI which is situated just before tab TR_FA.

2. As per your query, yes you will be covered under Article 16 of UK DTAA and you can claim 100% relief of taxes paid abroad (Condition: tax paid abroad be less than or equal to tax of foreign income calculated normally as per Indian laws, in short Tax in India on foreign income or tax paid abroad whichever is less, will be the relief). Hence relief = Tax paid abroad or tax calculated on such foreign income in India whichever is less
