Quick Summary
This discussion explores whether individual sellers of lassi or ice cream can claim Goods and Services Tax (GST) Input Tax Credit (ITC) on commission invoices from platforms like Swiggy or Zomato. The general consensus is that ITC is typically not available if the service is classified as 'restaurant service' due to a concessional GST rate of 5% which prohibits ITC claims. However, if the items are sold as goods, ITC might be claimable. The conversation also touches upon the importance of correct B2B vs. B2C registration for claiming ITC on commission invoices.

Not eligible as he enjoying the relaxation in the form of concessional rate of tax
No ITC cannot be claimed
ITC not available if under restaurant services.
If sale as goods then available
Sir is their any valid reason why we can't claim itc on swiggy comission invoice

Earlier GST rate was high for Restaurant service, at that time restaurant owner can claim ITC but later on to reduce the cost of food for customers, Govt. relax the rate from 12% to 5% with condition that ITC cant claim. If you want to claim ITC then you have to charge 12% GST from customer.

There is no option for 12% for restaurants. ITC not available if service but if food items sold as goods then itc available. So it is a matter of tax planning.

Restaurant service is composition scheme so ITC can't be claimed as it is charged @ 5%

as our resorts tieup with swiggy dine out and we are charging 18% gst on food and swiggy are sending us every month commission GST invoice but we checked the invoice are not showing in GST-2A.

becuase of they have registered our company under B2C instead of B2B.

can we claimed for ITC against commission invoice of swiggy ?
