My client purchased iron for construction of building used for self used to start own business . Can he claim ITC
To determine if your client can claim Input Tax Credit (ITC) on the purchase of iron for constructing a building for self-use to start their own business, let's break down the conditions: Conditions for Claiming ITC:
1. *Use in Business*: The goods (iron) must be used in the course or furtherance of business.
2. *Tax Invoice*: The purchase must be supported by a tax invoice.
3. *Registration*: The recipient (your client) must be registered under GST. ITC Eligibility: In this scenario: -
*Initial Stage*: The building is under construction, and the business has not yet commenced. -
*Self-Use*: The building will be used for self-use to start the business. GST Rules: As per GST rules, ITC can be claimed only when the goods or services are used in the course or furtherance of business. Since the building is still under construction and the business has not commenced, the ITC on the purchase of iron cannot be claimed at this stage.
Future Claim: However, once the business commences, and the building is used for business purposes, your client can claim ITC on the purchase of iron, provided they have a tax invoice and are registered under GST.
Recommendation: Advise your client to maintain proper records, including tax invoices, and ensure GST registration once the business commences.
This will enable them to claim ITC on the purchase of iron and other eligible inputs in the future.
Input tax credit on iron purchased can be utilized if iron used for purchase of business.
