Quick Summary
If you filed an Income Tax Return (ITR) 3 last year but no longer have business income, you can likely switch to filing an ITR 2 this year. The type of Income Tax Return form you can use depends on your income sources and residency status for the financial year. The Income Tax Department's restrictions primarily concern switching back to the old tax regime from the new one, and these are generally limited to businesses.
You can always change the type of return to ITR-1, 2, 3 or 4 depending on the income sources & resident status applicable for the Financial Year[ when the income got generated].
Only restriction added by I-T Department is about selecting back Old Tax Regime back from New Tax Regime, but this restriction applies only to businesses.
