Yes VAT is payable even in case od second hand sale.

Atleast this is the case in case of Maharashtra VAT, i dont know about other state acts.

There is no vat payable on sale of vehicle. As per decision of the supreme court, there is no vat payable on sale of vehicle.

 I want  to know about applicability  of  DVAT on SECOND (scrap) SALE of FIXED ASSET like vehicle & plant mechinery ,is this amount of sale icluded in our VAT return as TURNOVER. if  anyone have circular or nitification regarding this PLZ. mail me on 'madhvendra90 @ gmail.com'
