Reply to department that this notice which issued by you is invalid in law. so I need not to reply for same. but plz be ensure that it is invalid.

Yes first double check if the intimation received by you is barred by time. Then write the same to the department. Quote the sections/cases for which you think it is invalid.
In case it is still valid they will let you know.
