please guide me on below query
We are going for an appeal to the CESTAT (Appellate Tribunal) against order of Comm. (Appeal). CESTAT has granted stay for the pre-deposit of duty and interest. If we have lost the case in CESTAT, are we liable to pay interest on duty for the period for which stay is granted by CESTAT.
E.g. Duty Demanded Rs. 10 lac.
Stay granted on 01/01/2013. Judgement given by CESTAT against our appeal on 31/02/2013. Are we liable for the payment of interest from 01/01/2013 to 31/02/2013 as the stay is given by CESTAT? or we are liable to pay only duty and not the interest for this period.
