an agreement is a contract when there is an intention to create legal relation
in Balfour vs Balfour case
the court said that when it was made there was no intention to create legal relationship hence it is not enforceable by law
it's a social agreement
but if the husband wife had created a legal relationship while making the promise
will that be contract then?

Husband and wife is governed by respective religious ACT like Hindu marriage Act or any other relegion.
