Incorporation

We Apply company incorporation through route inc 29 ,but they reject due to name resemblence , but they said for getting that name u should have to purchase old company and then apply for name change of old company then u can get that company with name that we want . If Earlier ROC rejected inc 29 how can roc provide that name through this process. plz explain me and tell me rule or sec where this thing are provided?????????
