Its Urgent,

I Want to File a Return of ProprietorShip Business for the AY 2011-12,2012-13,2013-14

And the Situation is the proprietor Dies on 15th sept 2010 and now his Son take care of the Business an he want to file the Return,

so that his son file the return on his name Basis or As Legal Heir,

If as Legal Heir then what is the Procudure to be followed.

"Plz Provide the Proper Solution as earliest Possible".

Income tax return cannot be filed for AY 2011-12 as the last date for filing the same is 31.03.2013. And as far as AY 2012-13 and 13-14 is concerned u need to file in ur individual capacity not in the capacity of legal heir

Return for AY 2011-12 cannot be filed now. But u can file the return for AY 2012-13 and AY 2013-14. Since the first proprietor dies during AY 2011-12, you dont have to file AY 2012-13 and 2013-14 in legal heir capacity. You can file as your own return.

I totaly agree with Mr. Prashant, you can file a fresh return of son for AY 2013-14
