we will import under EPCG, but as the final product is not any export goods but it will use in our factory warehouse my query is how we will get EODC from DGFT as we have no export goods under this licence.

no , we are manufacturing company.

in case of failure to fulfill export obligation or any other condition of authorization , authorization holder shall be liable for action under FT(D&R) Act,1992, orders and rules made thereunder, provision of FTP and customs Act,1962.

First of all there are issues in getting the Forklift EPCG license since it is of dual nature. To assure the same you need to approach the DGFT HQ and take the valid permission since reginal offices may give you the licnese but onus will be totally on the co. to prove the same .

Further if you get it, then you can show your general export product .

You can import of Forklift as Capital goods under EPCG Licence if you prove  that the Fork Lift Trucks are distinctly different from ordinary trucks and are required for the purpose of loading, unloading and stacking of the material within the factory premises and are used in preproduction and post-production process in the confines of manufacturing unit ;The  ‘Electric Fork Lift Truck’ is not a ‘Truck’ per se but an equipment to move material inside the factory premises.However if you do not prove the licence acn not be issued.

If your regional licencing authority of DGFT refused to issue the EPCG Licence the case may be referred to the EPCG Committee.
