My firm imports shoes from West Bengal both taxable and exempted on the same purchase invoice under Form 38 issued by the authority. Now officer at sale tax office saying that exempted goods can not be imported on Form38. Is it true? He is asking for penalty.

THE GOODS FROM ANOTHER STATE IS INTERSTATE AND YOU UTILISED THE FORM-38 .
As per law you have to submit Form C for the interstate transactions. DEPARTMENT IS RIGHT.
We always submit Form C quarterly for all the purchases made during that quarter. These goods are imported from outside U.P. by declaring on Form38 which also includes exempted goods.
