Import invoicing

One foreign supplier failed to include one consignment in a consolidated Invoice + Bill of Lading. No reflection in export declaration to its customs. Importer also xame to know after customs clearance. How exporter can claim amount from Indian importer , when there is no evidence and bill of entry. Possibly wrong declaration, suppression in both ghe countries.
