IGST paid in case of EPCG license during interim period July 2017

Dear Sir/Ma'am


we have paid IGST against EPCG Authorization during interim period of 2017 .we have not claimed the refund of the IGST.

1. whether we have to apply for refund?
.2. or our export obligation will be reduced proportionately to the amount of IGST.

As per Section 54 the refund can be claimed within 2 year , so I don't think that now you can claim refund for the same.

Thanks for reply sir but as per Prince spintex vs UOI case , HC has allowed refund.

Can't we apply on gst portal under refund section by selecting other category

I don't think so... when it's clearly mentioned in act ,that it can be claimed within 2year , ultimately it will be get rejected.
