If deposit or not

Co Act 2013 473 views 2 replies

IF 1)Advance against Construction  2)Advance against land purchase  and     3) Trade payable - are treated as " DEPOSIT" and Form DPT-4 need to be filed. Advance under construction and advance against land purchase are under dispute between the party for a long time.

I dont think that they are deposits....refer sec 2 (c)(xii) of the Deposits rule......

But as per deposit rule, all those should be settled.  But in my case it is under dispute between the party and also pending in court. Example...advance against land or construction taken but registry not done due to dispute..
