Hra exemption query

Tax queries 952 views 10 replies

As per section 10(13A) exemption for HRA is available if rent is actually paid by employee & house is not owned by him.

Now, if a salaried employee is actually paying rent to his father for staying in the house owned by his father, then can he claim exemption of this rent, can we take the benefit of this section?

Yes, inmy view, but It would be advisable for the father, to declare this income in his/ her personal Income Tax return.

Can only rent payment receipt will do?

whether exemption for rent paid will be allow to employee who are residing in Company's Staff Colony at free of Cost & He is paying rent for Other House where his family residing ?

@ Devendra In my opinion in the case cited by u exemption of HRA shall be available provided the employee does not have his own house in that city. But if he is residing in company's quarter he would not be getting HRA in his salary in that case he cannot claim exemption for HRA u/s 10(13A) but can claim a deduction of the rent paid U/S 80GG.

REGARDS.
