if we take exemption of hosing loan interest, can we claim HRA exemption under Section 10 & 17?

means we have taken home loan where we don' live but we live in a rented flat.

so home loan interst & rent paid for current flat can be claimed at the same time?

Do you earn from the flat for which you have taken loan ? If yes, then you have to show the income from house property (i.e the rent which you are earing from the rent) showing the House Property as Let Out and claim HRA exemption.

Otherwise you cannot claim the HRA exemption as you have to show the house property as "Self occupied".

no the house is not rented out. it is in different city where Assessee's parents stay. & Asessee stays in a rented flat. he pays the home loan interset as well rent for current flat

As per my opinion you will not get HRA exemtion.

The amount of HRA exemption is deductible from the total income before arriving at a taxable income. This helps the employee to save tax. But do keep in mind that the HRA received from your employer, is fully taxable if an employee is living in his own house or if he does not pay any rent.
