How do I choose the correct trademark class? Can I change it later if I selected the wrong class?

Choosing the correct class is very important because trademark protection only applies to the goods or services covered by your application.

If the wrong class is selected, you generally cannot simply switch to another class after filing. In many cases, a fresh application may be required.

Always identify:

  • Current business activity
  • Future expansion plans
  • Related products/services

before filing.

  • Choosing the Class: Map the primary product/service to the Nice Classification (Classes 1–45). Always account for immediate future expansion before hitting submit.

  • Can it be changed? No. Material alterations or adding/switching classes post-filing is strictly prohibited under Indian trademark law.

  • The Remedy: If a wrong class is selected, the only definitive solution is to file a fresh application under the correct classification to ensure legal protection.
