House property clubbing of income

Hi

 

Husband pays money for buying a house.HE buys the house in wife's name .The transfer of asset is not a revocable transfer.There is no consideration paid by wife to husband,no transfer of jewellery from wife to husband .The payt done fully white (thru online bank transfers),out  of known source of income of husband(salary,tax deducted on salary)

 

The wife lets out the house in her name and recives the rent in her bank account.She has only income from other sources income from bk int around 5-7 lakhs p.a Should the rent be clubbed with husbands income under the head income from House Property.or wife can show as her own HP income?

in my opinion income from HP would be clubbed with the income of husband
The rental income will squarely clubbed in the husband hand
where any property is being transferred by the owner of the property otherwise than for inadequate consideration the income from such property wud be taxable in the hands of such transferor.
hence rental income wud get clubbed in the hands of husband

How would I show the rental income in the husbands return .This needs to be shown as HP Income .I will be filing ITR 2 for him.

IN case of Schedule HP in ITR2 ,should i show house as co Owned ?what percentages do i put in it for the husband?The wife owns it 100% though.the house in only in the name of the wife

 

and does he also to have to declare this house in schedule AL (Assets and liabilities) ,more than 50lakh total income.

 

income needs to be shown under House Property only
no need of showing it as co-ownwed and no percentage is required to be disclosed as husband is the only beneficial owner but to save tax it is shown in wife's name which is not allowed

Would the property be also shown  in schedule of Assets and Liab in the return of husband (itr2)?

not required as it is a residential property and no business is carried on from it
