Hiring Consultants

Dear Sir,

A person has incorporated an Company in UK and wants to Hire Indian Professionals as consultants and has no legal entity or permanent establishment in India .The professionals will work remotely for the company from India is the company has to comply with any rules or regulations in India also is there any restriction w.r.t to maximum no of Indian Professionals the company can contract.

  • UK Company: No Indian entity or registration is required as long as you hire independent contractors. Avoid treating them like employees to prevent "Permanent Establishment" tax risks.

  • Indian Consultant: Your income is taxable in India. You must pay advance tax if your annual liability exceeds ₹10,000, file an LUT for zero-rated GST, and maintain proper documentation (invoices, FIRC) for your tax filings.
