Help- tds on salary

can anyone please clarify whether tds can be deducted by employer if he is paying salary to an employee through his personal account. Also does the employer himself deduct this amount and pay to the Government. How to ensure that the employer is paying the tds or not? Please help me,since it is urgent, Thanks in advance.

The employer is liable to deduct TDS from the salary of the employee, deposit the same to the Govt, and quarterly file TDS returns. By 30th May, the employer will provide form 16 to the employee stating the total salary, TDS, allowance, etc paid for the year. The employee may also check 26AS to see the TDS deducted is propery deposited and returned filed.

The liability to deduct tax at source in case of salary is on all persons, including individuals irrespective of the fact whether such person is carrying on business or not.

Therefore the TDS from salary has to be deducted even when it is paid from personal account.
