considering recent notification dt 22.9.17, what is the gst rate on soyabean de-oiled cake ?

GST 5% for all Oil seed cakes,

EXCEPTION Cotton seed oil cake NIL RATED

but Oil cake contains oil elements & de-oil cake does not contains oil elements.

To the best of my knowledge, irrespective of what process of Oil extraction is followed and how much oil has been extracted, the leftover waste is called "Oil seed Cake".

"Oil Seed Cake" explains source of the commodity and doesnot define the Oil content.

pl refer earlier notification in which clearly mentioned as de-oiled cake and the same is exempt under chapter 23

Dear Nagesh,

Oil Cakes are De-oiled.

Please refer GST Council Notification of 09/09/2017 (copy attached)

Oil Cakes Rate from 1st July 2017 to 09th Sep 2017 was Nil for Cattle Feed

and 5% for other uses .

Effective 09th Sep 2017, irrespective of end use Oil Cakes are taxed at 5%.

Only exemption is for Cotton Seed oil cake.

Thanks but oil cake are taxed @ 5% de-oiled cakes are exempt as per chapter 23 up to recent notification no 27 & 28 dt 22.9.17 now the word de-oiled cake with entire bracket is omitted hence the question arise that doc will be considered under which chapter ? & at what rate?
