Whether itc can be claimed on the car used for the travelling for business purposes?

Hi, As per section 17(5) of CGST Act, input tax credit will not be available in respect of motor vehicles and other conveyances, except when: such motor vehicles or other conveyances are supplied further, or used for transportation of passengers or giving training on driving, flying, navigating such vehicles or conveyances or are used for transportation of goods. Hence, if your firm does a business that falls under any of the categories mentioned above, it can claim the input tax credit. Remember, both input tax credit of GST paid on purchase of such capital goods and depreciation u/s Income Tax Act 1961 will not be allowed together. You can either claim input tax credit of GST, or depreciation u/s Income Tax Act 1961.
No Sir as it is specifically BLOCKED under Section 17(5) of the CGST Act 2017.

Hello, As far as I can see Section 17 (5) of CGST Act got amended with in clauses like Clause (a), Clause (aa), Clause (ab) & Clause (b) The amendments carried out under Section 17(5) by specific clause of (a) can be summarized as below for your reference and records: Clause (a) 1. Motor vehicles used for transportation of persons, having an approved seating capacity upto thirteen persons (including the driver) - ITC disallowed subject to the below exceptions where the vehicle is used for: (A) further supply of such motor vehicles; or (B) transportation of passengers; or (C) imparting training on driving such motor vehicles; 2. Motor vehicles used for transportation of persons, having an approved seating capacity of more than thirteen persons (including the driver) - ITC allowed without any condition 3. Motor vehicles used for transportation of goods - ITC allowed without any condition Please correct me where I am gong wrong....
Sir,
whether one is using ITC or not ,it is in the Electronic credit ledger.Then why should I not make use of it.why it is not forbidden.some arrangement to be made in the GST port.
