GST ITC in case of Bus Leasing

ITC in case of Bus Leasing

Descripttion Company A is giving Buses on lease to Company B without operators(Without drivers/Conductors)
and charged GST 18% on lease amount.
Now Company B wants to claim the ITC of Tax paid to Company.

Confusion Can Company B claim the ITC because it has been taken buses on lease without operators?

Q Is lease of Bus mandatory with operators to claim the ITC???

Quick Summary
This discussion clarifies whether a company leasing buses without operators can claim Goods and Services Tax (GST) Input Tax Credit (ITC). The key factor determining ITC eligibility is the seating capacity of the bus. If the bus has a seating capacity of more than 13 persons (including the driver), ITC is generally available.

ITC is not available for Motor vehicles used to transport persons, having a seating capacity of less than or equal to 13 persons (including the driver)
Yes it is hold good
Offcourse assuming that the bus seating capacity is more than 13 person (including Driver) ,hence ITC is available.
