What if I have taken ITC of FY 2019-20 in the month of September 2020, but the return is filed after 20th October 2020. Is it ineligible?

Can you please elaborate on which basis we can consider it as eligible?

yes correct legally you are not allowed as in section 16(4) person is not allowed to take itc after the DUE DATE of furnishing of 3b (u/s 39) for the month of september following the fy.

As the due date is 20th, October for Sept.month return.so as per law its ineligible but as everyone availing the credit & officer is also not objecting it.

note : make it sure that it reflecting in your 2A/2B
