GST Evasion by Builder

273 views 1 replies
Good day all !

I have entered into a contract with builder for the construction of residential house in June 2017 at flat rate of 1500 per / ft

In July 2017 GST was introduced by Government. Although, the flat rate included taxes, He neither registered for GST nor paid any GST to Government or vendors to buy material for house and provided fake invoice in spite of doing business of more than 40 Lacs in 17 ~18 FY.

I want to lodge a complaint against the builder for tax evasion and want strict action taken against him. What is the best course of action ?

Hi G Singh,

You’re right to be concerned about GST evasion by your builder. Here’s what you can do:

Steps to Lodge a Complaint Against GST Evasion by Builder:

  1. Gather Evidence
Collect all documents related to your contract, payment receipts, invoices (even if fake), correspondence, and any other proof showing the builder’s business and GST non-compliance.

  2. File a Complaint Online
You can lodge a complaint about GST evasion directly on the GST Portal:

    • Visit www.gst.gov.in

    • Under the Services tab, find Complaints and select Lodge Complaint.

    • Fill in details about the builder, nature of evasion, and upload relevant documents.

  3. Contact Local GST Authorities
You can also approach the nearest GST Commissionerate or Superintendent office in your area with your complaint and evidence.

  4. Approach Anti-Evasion Wing / Tax Department
You can inform the Anti-Evasion Wing of the GST department or the Central Board of Indirect Taxes and Customs (CBIC).

  5. Consumer Forums / RTI
If needed, you may also consider filing a complaint with Consumer Forums or seeking information via RTI (Right to Information) to verify builder’s GST filings.

What Actions Can Be Taken?

  • GST department can investigate the builder’s records, and if evasion is confirmed, impose penalties, interest, and possibly prosecute under GST law.

Important Notes:

  • Ensure Your Complaint is Fact-Based: Provide clear proof, not just suspicion.

  • Stay Anonymous (Optional): You can choose to keep your identity confidential while lodging complaints online.

  • Legal Advice: If needed, you can consult a tax lawyer or GST consultant for professional help.
