In order to avail ITC, the invoice shall reflect in GSTR 2A of recipient. Since the supplier has not filed returns the invoice will not be reflected. It is suggested not to take ITC and follow up with supplier for filling returns.

CLAIM ELIGIBLE.
Suppose supplier wilfully issue fake invoice without uploading, can department take action on supplier on our complaint.
ITC is not eligible for invoices which are not reflecting in GSTR 2A.
