Query?
1 ) In a Partition suit case , an injunction order ( with Status quo ) already imposed by Hon'ble District Court on a business place ( Godown ) of my client .
2) Irrespective of an injunction order on that place , still a business(partnership firm) is carried on by a person ( my client's brother ) for a long period of time .
3) And during the f.y 2012-2013 , income tax return of that firm already filed by a chartered accountant ( by showing on that business place in the return ).
4) ONE YEAR ago, trade license ( of my client ) already issued by local authority .
5) Professional Tax certificate already prepared .
Questions:
1) Can i take a legal action against that person ( client's brother ) for violation of an injunction order ???
2) Can i take a legal action against that member of ICAI ( as it's a Tax audit file u/s 44AB ) for violation of an injunction order ???
Need a fast response .
