Gratuity is payable to an employee on the termination of his employment after he has rendered continuous service of 5 years on his superannuation or on his retirement or resignation or death or disablement.. how ever condition of 5 years doesnot apply if termination of employment is due to death or disablement.... so if u work for 4 years and 8 months u r still not entitled to gratuity unless u r disabled..
