Form 'F' under CST

Dear Sir, Can you enlighten me on following : A private limited company dealing in cosmetics products, appointed various dealers in many states. Stock is transferred to dealers against form 'F'. Dealers provided one form 'F' for full year. As per amended Rule 12(5) of CST, from 11.05.2002 MONTHLY form 'F' are required to be produced. But, the Company has only one form 'F' for the whole year. Sales Tax department has raised demand notice for year 2001-02 and for 2002-03 disallowing all the stock transfers on the technical ground that only one form 'F' is produced for the whole year instad of monthly, as required. As per statutory compliance, submittion of month wise 'F' forms is required but upto F.Y. 2002-03, a dealer can prove stock trf. as a geneuine one by filing month wise certificates instead of F form with copy of G.R. & stock trf. invoice to the authority.
