Form C duplicate allowed?

684 views 5 replies

The customer A has already issued form-C to party B, but the same has been lost by B. Can A issue duplicate form-C, on B providing indemnity bond to the Govt? What are the further requirements if any, like publication in newspaper etc?

Some people say that based on some supreme court decision, duplicate form-C are not allowed anymore?

Please throw some light. Thanks,

No Duplication........

But as per my knowledge,

a FIR is to be filed & then sales tax dept. will issue C form & that is also not of that same number......

Dear agarwal,

You are correct. ONly FIR can be filed. But ST will not issue c form in same number. but you can issue c form - new

serial number.

Dear Rakesh,

The purchaser needs to obtain the Police complaint from the seller (who has lost the form) as proof.  Based on the proof so obtained, a new form can be obtained and issued with an endorsement on the form stating that this is issued in lieu of forms earlier issued....

B has to file FIR and publish in Local newspaper (English and local language) Based on FIR A will apply for duplicate C-Form

Thanks to all for responses. Has anyone gone through this process themselves? Can the relevant circular/rule be shared?
