Form 16 not given by employer

Hi,

I Worked with a small company for the period of Oct 2011 to Oct 2012 and I was not provided with any form-16 for that period. My payslips doesn't show any TDS deductions nor my salary  is not eligible for tax.

Now, my current company is asking for Form-16 and when I approach for the same with previous
employer, they are not responding. 

Since, they are not responding, I would like to file my returns myself or through company to get Form-16 for that period.


What is the proceedure I need to follow? Since, no TDS was deducted on my salaray, what if the company gives fake fomr-16 and how can I cross verify it?

You can register yourself on incometaxindiaefiling website and find out how much TDS is deducted by your previous employer by checking on form 26AS. But sometimes the amount of salary Income (TDS matches form 16) mentioned in 26AS does not match exactly with form 16 as also it will be difficult to obtain other particulars like HRA etc.

In the absence of Form 16 from previous employer and when they are not ready to help, another way apart from the one illustrated by Madhavi is to provide them the pay slips. If the previous company has not deducted any tax from salary payment (which is apparent from pay slips) they may not issue you form 16. Strictly speaking form 16 is not a salary certificate but a certificate for tax deduction at source.

It is strange that every employee of a company expects Form 16 even if there is no tax deduction. It has been equated with a salary certificate. This is due to bank people.
