Dear All,

I have one query.

I have two employer in f.y.2010-11 from first employer i get the gross salary 50000 and from second employer I am getting gross salary 150000

now i reported to my current employer my previous salary50000, so my gross salary is 200000 for 2010-11 before any exemptions / deductions.

After deduction/exemption my taxable income is 155000.

My question is can i get form 16 as per rule because my employer not ready to given me form 16 and given me reference of Rules.

If there is any provision in Income Tax Rule for getting form 16, please help me because I want to apply home loan, and banks are not given loan without submitting form 16.

you can file return of your own based on salary slips.

Dear Vishal,

You have not mentioned whether your employer has deducted any TDS during the year or not ??? If he has deducted, then he has to issue Form 16. If he has not done so then you may file return on your own as per Mr. Sharma. That would work for your loan purpose.

Also, banks would ask for salary slips & Tax returns. They won't ask for Form 16 as I believe so. Please correct me if I am wrong.

Dear Vishal 

If your employer has deducted NIL TDS from you then he may not issue you any Form-16 for the relevant period.

In such case you file your Income Tax Return  based on your salary slip as advised by  Ashish. The Income Tax Return Acknowledgment will solve your purpose.
