Form 13 us 197 of income tax act

hi sir,

Im a foreign citizen (also a NR) but a person of indian origin. I've a house property in india and now i want to sell it off (LTCG arises). Now on sales my CG would be below the basic exemption limit hence i donot have to pay any tax. But on sales buyer will deduct tax on source. So to avoid that i want to apply to ITO to issue a certificate to the buyer not to deduct tax.

Here my question is, being a foreign citizen and a NR, can i apply by using form 13 for such non deduction, or is it avaibale only for residents. If not possible what else am i supposed to do?
