Is it not the duty of the principal to send form 108 to the institute?

Vivek - Please fill up form 119, send one copy to the institute and another copy to the principal. Basing on form 119, principal has to fill up form 108 and take the signature of the student and send it to the institute.

Correct me if I am wrong.

But in case if the student has not completed excess leave and the principal refuses to sign the form 108 then when is the remedy available

As suggested above, what if even e-sahayata asks for submission of form 108 first and then reply to your query

Dear Amit,

In case the article clerk has taken excess leave, then Form 108 should be sent along with Form 107 to the institue within 60 days. Pls refer the attached file.

Even if you post the query in E-Saahaya, they cannot ask the student to submit form 108 since it is not his duty. Then can say that submit form 119. If they say that student has to submit form 108, then it is their mistake. We can fight this case.

In my view, krishna is correct. Secondly, principal is bound to sign form 108. You can complain about your principal to icai through e - sahayataa.. but just be sure that you have enough evidence to prove yourself, because maximum time, institute favours their members and not students... just be careful. I may be wrong, but thats what i have seen till now.

I completely agree with you. Most of the the times, institute favours members only. That's why these members are enjoying a unfair advantage over students. Even I had different problems during my articles period. In my opinion why can't we have students group where in there can be head for each region. If any student has problem regarding and articleship and unfair rules laid down by icai, he should contact this group and report the issue, This group head will report the same to the higher authorities and he will make sure that justice is done. He should also have direct access if ICAI is making any rules and regulations regarding article training and examination.

I request all the members to think about this. By this we not only protect the genuine student problems and we are also assuring the coming students that we all are there for you.

Dear friends i have completed my excess leave with my employer. But even after lot of persuasion my employer does not want to sign my form 108 . As a last resort i posted grievance to icai at e-sahayataa but the only reply i got is '' Dear Student please settle the matter with your employer amicably and submit form 108 for further process at our ends''. 

It seems like there is nothing we can do. Is it???
