For section 139(2) and section 139(10)
dear sir
1. what is no auditor is appointed in AGM of the company and it is the year of termination of 5 year terms of the auditor??
2. Is sec 139(10) applicable which states that "where at any AGM, no auditor is appointed or re-appointed, the exiting auditor shall continue to be the auditor of the company???
3.what if even a listed company to which section 139(2) is applicable fails to appoint auditor in its AGM and been the last of auditor's term??

if a listed company to which section 139(2) is applicable fails to appoint auditor in its AGM and been the last of auditor's term, then the board shall appoint another individual/firm of auditor as per the procedures

but if board also failed too
then what should do??
If such condition appears then it will be a casual vacancy and so no automatic reappointmemt will be done.
If bod doesnt appoint any auditor within 30 days then it will be contravention of law and legal action will be taken accordingly
