First auditor appointment

Dear Sir, There is one Private limited Company incorporated on 24/01/2014. So for that company need to appoint First Auditor. My question is what will be the Period covered by First Auditor. Is it 01.04.2014 to 31.03.2015 or 24.01.2014 to 31.03.2015. and what is the provisio for the same in Companies Act, 2013.

I also want to know if first auditor is appointed for 5 years do we have to file intimation with ROC??

Tenure will be upto first agm from date of appointment So from 24.4.14 upto date of agm First auditor can be appointed only for one year after that his appointment will be as subsequent auditor. So follow provisions of subs. Auditor

U/S 139(6) of the companies Act 2013:-The First Auditor will hold the office till the conclusion of the First AGM.

U/S 139(1) of the companies Act 2013:- A company shall appoint an individual or a firm of Chartered Accountants as company auditor in the First AGM, who will hold the office from the conclusion of the First AGM till the conclusion of the Sixth AGM.

As  per  Sec-139(6) First  auditor  shall  hold  the  office  from  the  date  of  appointment  to the date  of  first Annual General  Meeting.
