Filing of Form DPT-3

A closely held public limited company has availed secured loans from Scheduled Bank. However the company has not availed any unsecured loan or deposits. In other words the company has availed loan only from bank and there are no other loans outstanding. My query is whether the company is required to file Form DPT-3 compulsorily with ROC / MCA. Please clarify

Quick Summary
This discussion clarifies the requirement for closely held public limited companies to file Form DPT-3 with the ROC/MCA. Even if a company has only availed secured loans from a scheduled bank and no other unsecured loans or deposits, it may still need to file. Following amendments to deposit rules, companies must now report exempted deposits, including outstanding secured borrowings as of March 31, 2020.

Yes ofcourse , after amendment in deposit rules now company has to report Exempted deposit also . So if this amount is outstanding as at year end then you ll have to file dpt _3 ( purpose of the form - particulars of exempted deposit will be selected in DPT_3) even if there is no other outstanding amount/ deposit
Yes... secured borrowings too shall have to be reported outstanding as March 31, 2020
