can I file income tax return for AY 16-17 and 17-18 with or without penalty. how much amount of penalty

No. Now returns of earlier years cannot be filed, unless any query from ITD.

if you have a refund due, file a condonation request with jurisdictional CIT. once the request is accepted, you can file the return

No way for filing ITR for AY 16-17 and 17-18 in normal provisions...
May be You have any Refund claim then You can file condonation delay request. The request is accepted then You can file ITR for the above said Years...

It cannot be filed under nomal course. however return u/s 142 can be filed after receipt of notice from ITD
