Extension of articleship

Dear Pragyat
First of all make it clear that 156 days leaves are allowed on a proportional basis. You can not claim 156 days leaves in the first or second year saying that you have 156 days.
You joined Articleship on 25 Mar 2014 therefore your attempt should fall on Nov 2016 as you are completing 2.5 years on or before 31 Oct 2016.
This is a General case
But
In your case you have taken leaves of 310 days and ICAI has given you 94 days leaves on a proportional basis. For calculating your Final attempt, 2.5 YEARS OF ARTICLESHIP SHOULD END BEFORE THE MONTH OF ATTEMPT INCLUDING ANY EXCESS LEAVES. (30 April for May attempt and 31 Oct for Nov attempt)
Your excess leaves are 216.
Now 25 Mar 2014 + 2.5 years + 216 days = 25 sept 2016 + 216 days = 29 April 2017

By Almighty blessings your 2.5 years are completing on or before 30 april 2017 which is deadline for May 2017 attempt.
Had it crossed 30 april your attempt would have been Nov 2017.
You are IN by 1 day
So Calculation is done in this way.
Go ahead for May 2017

Leaves taken after your rejoining of Articleship will make no impact unless and untill you take another transfer.
There will be no adjustment of Remaining 62 days leaves with 216 Excess leaves as I told you it is proportional calculation.

Do your calculation once more in this way only. Make contact with ICAI because you have only 1 day in your hand. In any way it should not cross 30 april 2017

but one more thing to clarify i.e according to present situation normally my artcleship is completed on 24 march 2017 but now due to excess leave of 216 days now my articleship will be completed on 27 oct. 2017. i wanted to ask fr calculating may 17 attempt we have to see till 30 apr there should be a balance of 6 months in artilceship completion including excess leave. hence i have 6 months also the dead line margin is 4 days.

Sir please clarify Am i correct or Wrong.

Sir i mean to say that as after adjustment of excess leave of 216 days my atricleship will be completed on 27th October 2017 instead of 24 march 2017.

As per ICAI if i want to give exams in may 17 then my atricleship must get complicated within the period upto 31st October 2017 i.e within 6 months from relevant attempt.

Hence according to this i have 4 days margin to save my attempt of may 17.

i had asked icai for transfer in my 2nd year of articleship period after getting consent letter signed from my ca. now after getting the approval from icai my ca is denying me to take transfer and sign form 109. he is asking me to take leaves for my medical treatment and serve extension later. i dont want to to do that, i want to serve my articleship period nearby my home so that i dont have to serve any extension or delay my final attempt. i dont have any idea, please suggest me something good plz.

Dear Amit,

ICAI clearly mention that any kind of greiviance between you and your principal will not be entertain by them.

In your Case since your principal has already signed his consent for giving you transfer but after approval he is denying then u must Contact to ICAI. In my opinion Your principal is now bound with that consent.

Also you must mention additional Ground that you don't want to exttend your articleship to ICAI.

Please  tell me which form need to be filled for serving extension in another firm .

My CA is not giving me exam leave as i have taken excess leave, my attempt is due on may 2017. Is there any measures that an article can take against a CA.

Dear Himanshu If u change ur existing principal for serving ur extension period then u need to fill form 103 to be signed by ur new principal

which form need to be signed by exsisting principal
