Excise Duty on Software Export Firm (STPI Scheme)

Dear Club Members,

 

Please help me understand one issue, Do Software Export Firms (100% EOU Registered with Software Technology Parks India) need to pay any excise duty ever?

I researched at some forums related to STPI, some say 10 year Tax break was upto Year 2009 only. any registered unit after that will have to pay excise duty. some forums suggest that from the date we register with STPI we get 5 Year Tax holiday.

I need to know what are the options available under STPI scheme in Punjab.

export is exempted from excise, but STPI or SEZ has control of customs and excise more than normal limits for their bonded area and duty free imports usage. 

so please put your query in more details,

Q. No 1. If an Indian subsidiary exports software to an US holding company, is the export taxable and what is the custom duty rate on export ??

 

Q.No.2. If the Indian subsidiary is an 100% EOU Registered with Software Technology Parks India and exports software to the US holding company is the export still taxable.

 

Q.No.3. If the US holding company supplies Server and Computer etc like ,, capital expenditure,..  is there and import duty on the things imported ? and can can company claim credit on the export duty ?
