Employer refusing to revise Form16

Hi Everyone,

I am having an issue with my previous employer not revising the form16 he has issued in April. He has issued a form16 with incorrect amount of section 80c for Mutual Funds in april. I have not checked Form-16 so far and when I checked it yesterday, I found the amount reduced and incorrect.

When I contacted my previous employer, Payroll department is refusing to revisit the form16 as the March 2009 year is over and their books are closed. But I have recieved form16 only in April, so they have sent it only after closing their books. Even after talking to many people, no one seems to be cooperating in rectifying their mistake.

Please let me know what are my options other than just accepting their refusal to correct their mistake.

Dear sir,

In case of wrong amount shown u/s 80C, we are not required to be worried about. We should show correct figures in income tax return. No need to correct old form 16.

Hi,

so if i just reduce my taxable income and put it in ITR, will IT accept it (even though the taxable income i put it in ITR is different from what is mentioned in Form16)?

there is no need to worry. U can claim exemption U/s 80C not shown in Form 16 by showing proof of investment in mutual funds while file of return. but return should be filed on time. last date is 31st july. so be on time.
