Effect of ammendment

Hi,

"commercial training or coaching centre" means any institute or establishment providing commercial training or coaching for imparting skill or knowledge or lessons on any subject or field other than the sports, with or without issuance of a certificate and includes coaching or tutorial classes but does not include preschool coaching and training centre or any institute or establishment which issues any certificate or diploma or degree or any educational qualification recognised by law for the time being in force;

MKCL is promoted by the Department of Higher and Technical Education, Government of Maharashtra, India & the stakeholders include the Government of Maharashtra (GoM) along with  Eleven Universities in the state & others.

Therefore in my opinion, the cert. issued by it will be the one  recognised by law for time being in force & hence may not have any impact of budget amendment.

In my opinion, the Budget amendment has been made so that autonomous coruces run by the Management Schools which are owned by the trusts should not escape the levy because of the use of the word "commercial" in the definition.
