Our company has taken consultancy services from Taiwan and the client has no office in India. Please advise us on which rate withholding tax deducted on the payment made to consultant.

Indian currency value of services taken has to be worked out.Service tax @ 12.36% on the value so determined has to be deducted and withhold and in my opinion same has to be releasd only against documetary proof i.e deposit of service tax through GAR-7 challan by the party.
our clients residents have a business firm in UAE free trade zone. the firm is a non resident and it enjoys exemption there. As per DTAA agreement will that income be taxed in india as no tax is paid in that country?
