Hi,

We are purchasing Domain from godaddy also renewal of domain.

whether we are require to deduct tds? than under which sec & tds rate. 

Also we are require to file 15 CA form ?

What entry you hv passed while purchasing the domain registration.

1. Godaddy is a foreign company and it will be treated as non-resident for the purpose of deduction of TDS. 
2. The above payment made to Godaddy is in the nature of contact and TDS u/s 195 @ 30% will need to be deducted. 
3. Any payment which attracts TDS in relation to foreign currency will require the payer to submit Form 15CA. 
4. In your case TDS need to be deducted @ 30% and it should be supported by form 15CA. 
Please correct me if the above soliton has an alternative view.

Godaddy representative told TDS rate is 10.82% and that much amount only will be refunded by them

So TDS rate is 10.82% or 30%?

Do will require 15CA to submit bank also or just filing online.(as payment will made online)

 

1. Ask for the relevant document from Godaddy for deduction of tax at 10.82%. Normally it is 30% (excluding surcharge and Edu cess) and at the time of deduction surcharge and education cesses are added and deductions are made. 
2. Since you have specified that representative has specified that TDS is to be @ 10.82% there must have been documentary proof evidencing for lower deduction of tax. 
3. And with respect to form 15CA, it is must whenever foreign currency remittances are made through banking channel. Form 15CA should be filed and then submitted to the bank so that foreign remittances will be processed by the bank. 
Please correct me if the above solution has an alternative view. 

Payment is online through net banking. So whether 15CA required to submit to bank?

Mostly it's not needed. 

I doubt Mr. Suresh there wiLL GST CHARGED IN THE BILL.
the expenses can be amortized but tds is not applicable. Instead GST IS APPLICABLE.
JUSTIFY WHY TDS IS APPLICABLE?
THE PAYEE CAN DEDUCT TDS @ 1% OR 10% DEPENDING UPON THE NATURE OF CONTRACT.
